Terms and Conditions for Ephemeral Astrology

Welcome to Ephemeral Astrology. These Terms and Conditions (“Terms”) govern your use of the website located at https://ephemeralastrology.com (the “Site”) and your purchase of our digital calendar subscription and related astrological reading services (collectively, the “Service”) provided by Being Ourselves (“Ephemeral Astrology,” “we,” “us,” or “our”).

By accessing or using our Service (including purchasing a subscription or a reading), you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not use the Service.

PLEASE READ SECTION 11 CAREFULLY, AS IT CONTAINS A BINDING ARBITRATION CLAUSE AND CLASS ACTION WAIVER, WHICH AFFECT YOUR LEGAL RIGHTS.

 

1. Description of Service

Ephemeral Astrology provides two main services:

  1. Digital Calendar Subscription: A subscription service where users are granted access to a proprietary Google Calendar. This calendar contains 300+ astrological transits, including times, degrees, and readings. Upon subscription, you will be invited to access this calendar.
  2. Astrological Readings: One-time, personalized astrological readings conducted by us, which are scheduled and purchased separately.

IMPORTANT DISCLAIMER: All content, calendar data, readings, and services provided by Ephemeral Astrology are for entertainment purposes only. The Service does not provide, and is not a substitute for, professional medical, psychological, financial, or legal advice. You should not rely on any information provided by the Service as a basis for making personal, medical, financial, or legal decisions.

 

2. User Eligibility and Accounts

You must be at least 18 years of age (or the age of legal majority in your jurisdiction) to purchase any Service. By agreeing to these Terms, you represent and warrant that you meet this age requirement.

To manage your purchases, you must create an account. You are responsible for safeguarding your password and for all activities that occur under your account. You agree to provide information that is accurate, complete, and current, including a valid email address for delivery of the Google Calendar invitation.

 

3. Payments, Subscriptions, and Refunds

3.1. Payment: You agree to pay all fees or charges to your account in accordance with the fees, charges, and billing terms in effect at the time a fee or charge is due and payable. We use a third-party payment processor (Stripe) to bill you through a payment account.

3.2. Calendar Subscription: The calendar subscription is billed in advance on a recurring and periodic basis (e.g., monthly, annually). Your subscription will automatically renew at the end of each billing cycle unless you cancel it.

3.3. One-Time Readings: Fees for one-time astrological readings are charged at the time of booking.

3.4. Refund Policy:

  • Calendar Subscription: We offer a 7-day money-back guarantee for your first subscription purchase. If you are not satisfied with the Service, you may request a full refund within seven (7) days of your initial subscription date. After this 7-day period, all subscription fees become non-refundable.
  • Astrological Readings: Fees for one-time astrological readings are non-refundable. However, you may reschedule your reading or request a full refund if you cancel at least 24 hours prior to your scheduled appointment. Cancellations or “no-shows” with less than 24 hours’ notice will result in forfeiture of the fee.

3.5. How to Initiate a Refund or Cancellation: To manage your account, cancel your subscription, or initiate a refund for an eligible purchase (in accordance with our policy in Section 3.4), you must log in to your Account Page, which is accessible via the link at the top of the Ephemeral Astrology website.

  1. Navigate to your Account Page.
  2. From your Account Page, you will be directed to our secure Stripe customer portal.
  3. Within the Stripe customer portal, you can cancel your subscription or initiate a refund request for eligible transactions.

If you cancel your subscription, your access to the Google Calendar will be revoked at the end of your current paid billing cycle (unless a refund is issued, in which case access is revoked immediately).

 

4. Intellectual Property & Limited License

4.1. Our Content: The Service and its original content, including all data, text, and interpretations within the Google Calendar, and all content on the Site (the “Content”), are and will remain the exclusive property of Being Ourselves and its licensors. The Content is protected by copyright and other intellectual property laws.

4.2. Limited License: We grant you a limited, non-exclusive, non-transferable, and revocable license to access and use the Ephemeral Astrology Google Calendar for your own personal, non-commercial use only.

4.3. Restrictions: This license is strictly conditional on your compliance with these Terms. You are expressly prohibited from:

  • Sharing, publishing, or distributing the Google Calendar invitation or its contents to any third party.
  • Copying, scraping, reselling, or redistributing any data or text from the calendar.
  • Using the Content to create a competing product or service.

Any breach of these restrictions will result in the immediate termination of your access to the Service without refund.

 

5. Termination

We may terminate or suspend your account and revoke access to the Service (including the Google Calendar) immediately, without prior notice or liability, for any reason whatsoever, including but not limited to a breach of these Terms.

You may terminate your account and subscription at any time by following the cancellation process outlined in Section 3.5.

 

6. Third-Party Service Dependency (Google Calendar)

The Ephemeral Astrology subscription service is dependent on the functionality and availability of Google Calendar, a third-party service. We are not responsible or liable for any service interruptions, outages, or downtime of Google Calendar, or any technical issues related to your personal Google account.

 

7. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL BEING OURSELVES, ITS AFFILIATES, DIRECTORS, OR EMPLOYEES, BE LIABLE FOR (A) ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES; (B) ANY LOSS OF PROFITS, USE, DATA, OR GOODWILL; OR (C) ANY DAMAGES ARISING FROM YOUR ACCESS TO OR USE OF THE SERVICE, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM THESE TERMS OR THE SERVICE IS LIMITED TO THE GREATER OF (I) THE AMOUNT YOU PAID US IN THE SIX (6) MONTHS PRECEDING THE CLAIM, OR (II) ONE HUNDRED DOLLARS ($100.00 USD).

 

8. Indemnification

You agree to defend, indemnify, and hold harmless Being Ourselves and its licensee and licensors, and their employees, contractors, agents, officers, and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney’s fees), resulting from or arising out of a) your use and access of the Service, or b) a breach of these Terms.

 

9. Governing Law

These Terms shall be governed and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions.

 

10. Dispute Resolution and Arbitration

10.1. Mandatory Arbitration: You and Being Ourselves agree that any dispute, claim, or controversy arising out of or relating to these Terms or the breach, termination, enforcement, interpretation, or validity thereof or the use of the Service (collectively, “Disputes”) will be resolved solely by binding, individual arbitration and not in a class, representative, or consolidated action or proceeding.

10.2. Class Action Waiver: YOU AND BEING OURSELVES AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.

 

11. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days’ notice prior to any new terms taking effect.
